What is the lawsuit about?
The Class Action alleges that Defendants violated consumer protection and other
laws in marketing VytorinŽ and ZetiaŽ. The Class Action alleges that this resulted
in consumers and insurers paying too much for these prescription drug products.
Defendants deny any wrongdoing and liability. They agreed to the Settlement to resolve
the controversy and to avoid the burden and expense of further litigation.
How do I know if I am included in the settlement?
You are a Class Member and will be included in the Settlement if you paid some or
all of the purchase price for VytorinŽ or ZetiaŽ from November 1, 2002 through September
17, 2009.
What does the Settlement provide?
Consumers will share $12,450,000 of the Settlement Amount after deduction for attorneys
fees and expenses awarded by the Court. The remaining amount will be paid to Consumers
based on the amount they paid for VytorinŽ or ZetiaŽ in proportion to what was paid
by all Consumers who submit eligible claims (known as a pro rata share).
